In short: Waste classification determines the regulatory category of excavated soil, spoil and similar materials so they can be sent to the correct licensed facility — or lawfully reused. Getting the classification right controls disposal cost, keeps a project compliant, and often unlocks reuse that would otherwise be sent to landfill.

What is waste classification?

Waste classification is the process of characterising a waste material — most commonly excavated soil, spoil, stockpiled fill or demolition material — and assigning it to a regulatory category that determines how it may lawfully be managed. For soil leaving a development, infrastructure or remediation site, classification answers two practical questions: where can this material legally go, and what will that cost?

The category is not a guess. It is established through a structured programme of sampling and NATA-accredited laboratory analysis, with the results compared against the thresholds set out in the relevant state framework. Because those thresholds differ between New South Wales and Victoria, material is always classified against the rules of the jurisdiction in which it will be disposed of or reused. A correct classification protects the landholder, the contractor and the receiving facility, and it is a document that regulators, waste facilities and auditors rely on.

Waste classification frequently follows a Detailed Site Investigation, where soil has already been shown to contain elevated concentrations of contaminants and needs to be moved. It is equally relevant to clean projects, however, where the goal is simply to confirm that surplus soil is suitable for reuse rather than defaulting to expensive landfill disposal.

When do you need waste classification?

You will generally need waste classification whenever soil or spoil must leave a site, or where surplus material is proposed for reuse. Common triggers across the region include:

  • Excavation and earthworks that generate more spoil than can be reused on site — for basements, footings, dams, roads and services;
  • Disposal of surplus soil to a licensed landfill or resource-recovery facility, which will not accept material without a valid classification;
  • Reuse of soil on another site, where you need to demonstrate the material meets the criteria for VENM, ENM or clean fill;
  • Development and infrastructure projects — subdivisions, commercial builds, roadworks and utility works — where large volumes of material must be tracked and disposed of lawfully;
  • Remediation projects, where contaminated soil is excavated for off-site disposal or treatment.

For developers and civil contractors working around Albury, Wodonga, Wangaratta, Yarrawonga and Shepparton, disposal is often one of the larger and least predictable line items in a project budget. Classifying material early — before the excavator arrives — turns that uncertainty into a known cost and a defensible plan.

Classify before you dig, not after you stockpile. Knowing the classification in advance lets you segregate clean and impacted material at the source, avoid double-handling, and direct each parcel to its cheapest lawful destination.

Waste classification in NSW

In New South Wales, waste is regulated under the Protection of the Environment Operations Act 1997, and classification follows EPA NSW's Waste Classification Guidelines (2014). The guidelines assign waste to one of several classes:

  • Special waste (such as asbestos waste and certain tyres);
  • Liquid waste;
  • Hazardous waste;
  • Restricted solid waste;
  • General solid waste, either putrescible or non-putrescible.

For excavated soil, classification uses chemical analysis that measures both total contaminant concentrations and leachable concentrations (using the TCLP and SCC tests), compared against the thresholds in the guidelines. Where natural material is not contaminated, it may be managed as Virgin Excavated Natural Material (VENM) and reused without further approval. Where natural material meets specified criteria, it may be lawfully reused as Excavated Natural Material (ENM) under an EPA resource recovery order and exemption. Correctly establishing VENM or ENM status can dramatically reduce disposal costs on NSW projects around Albury, Thurgoona, Howlong, Corowa, Holbrook and the broader southern NSW area.

Waste soil categorisation in Victoria

In Victoria, waste and soil are regulated under the Environment Protection Act 2017 and the Environment Protection Regulations 2021, administered by EPA Victoria through its industrial-waste and priority waste framework. Rather than the NSW class system, Victorian contaminated soil is generally categorised — for example as Category A, B or C contaminated soil — or assessed as fill material or clean fill, with disposal categories determined in accordance with EPA guidance.

Under the Act, generators and handlers of waste carry a general environmental duty, and specific priority waste and reportable priority waste duties apply to how certain materials are classified, tracked and consigned. As in NSW, the category is established by sampling and NATA-accredited laboratory analysis against the relevant thresholds. For projects in Wodonga, Wangaratta, Benalla, Yarrawonga, Mulwala and Greater Shepparton, we assess material against the Victorian framework so it can be directed to an appropriately licensed facility or reused where the results allow.

Sampling and laboratory analysis

A classification is only as good as the sampling that supports it. We design a sampling and analysis plan that reflects the volume and variability of the material, the history of the site, and the guideline being applied. The number of samples is scaled to the tonnage or the size of each stockpile, with a higher sampling density where the material is heterogeneous or contamination is suspected.

For each characterisation we typically:

  • Review the site history and any earlier investigation to target the right analytes;
  • Collect representative samples from in-situ soil or from formed stockpiles, following a documented pattern;
  • Analyse for the relevant suite — which may include heavy metals, total recoverable hydrocarbons, BTEX, PAHs, OCPs/OCPs, asbestos and, where warranted, PFAS;
  • Run leachate testing (TCLP/SCC) in NSW where total concentrations approach the relevant thresholds;
  • Compare results against the applicable NSW classes or Victorian categories.

All laboratory testing is undertaken by a NATA-accredited laboratory, and results are interpreted by an experienced environmental scientist, not read off a spreadsheet. Where a stockpile returns a mixed result, we can advise on segregation so that clean material is not penalised by a small volume of impacted soil.

Disposal and reuse pathways

The purpose of the exercise is to identify the most lawful and cost-effective destination for every parcel of material. Depending on the results, the likely pathways are:

  • On-site reuse — clean material retained and reused within the project, avoiding haulage entirely;
  • Off-site reuse as VENM or ENM (NSW) or fill material (Victoria) — the lowest-cost off-site option where the material qualifies;
  • Disposal to a licensed landfill at the appropriate class or category — general solid, restricted solid or, for impacted material, a higher-order facility;
  • Specialist disposal or treatment for hazardous, asbestos-affected or PFAS-affected material at a facility licensed to receive it.

Because disposal cost rises steeply with each higher classification, an accurate result frequently pays for the assessment many times over. Just as importantly, it gives contractors and landholders confidence that material has been managed lawfully and can be traced if questions are ever asked.

What is VENM and how does it differ from ENM?

Virgin Excavated Natural Material (VENM) is natural soil or rock that has been excavated from areas not affected by contamination and contains no manufactured or foul material — it can generally be reused without further approval. Excavated Natural Material (ENM) is natural material that meets specified chemical thresholds and may be lawfully reused under a NSW EPA resource recovery order and exemption. Both are established by sampling and laboratory analysis.

How does waste classification differ between NSW and Victoria?

In NSW, waste is classified under the Protection of the Environment Operations Act 1997 and the EPA Waste Classification Guidelines (2014) into classes such as general solid, restricted solid, hazardous, liquid and special waste, with VENM and ENM as reuse pathways. In Victoria, soil and industrial waste are assessed under the Environment Protection Act 2017 and the Environment Protection Regulations 2021, where contaminated soil is categorised (for example Category A, B or C) or assessed as fill material, with priority waste duties applying. The two frameworks use different terminology and thresholds, so material is classified against the rules of the state where it is disposed of.

Do I need waste classification for a subdivision?

Often, yes. Where a subdivision, development or infrastructure project generates surplus soil or spoil that must leave the site, that material must be classified so it can be lawfully disposed of at a licensed facility or reused. Classifying the material early lets you plan haulage and disposal costs and identify soil that can be reused on or off site as VENM or ENM.

How many samples are needed to classify waste soil?

Sampling frequency depends on the volume of material, how variable it is and the guideline being applied. The NSW and Victorian frameworks set indicative minimum sampling rates based on the tonnage or volume of soil or the size of a stockpile. More samples are required for larger or heterogeneous volumes and where contamination is suspected. We design a sampling plan that meets the relevant requirements while controlling analytical cost.

Can PFAS-affected soil be classified and disposed of?

Yes. Where PFAS is suspected — for example near former firefighting-training areas, airports or some industrial sites — we include PFAS in the analytical suite and assess the results against the relevant PFAS guidance. PFAS-affected material requires careful characterisation and disposal at an appropriately licensed facility, and reuse options may be restricted. We identify the pathway before the material is moved.
